Bankruptcy Services in Atlee Virginia

If you’re facing foreclosure and are unable to make the minimum payment on credit card bills and car loans, bankruptcy may be the best option available for saving your home and regaining your financial footing.

Once you file for either Chapter 7 or Chapter 13 bankruptcy, an injunction known as the “automatic stay” goes into effect. The automatic stay requires creditors to stop all collection actions, including lawsuits. Banks and mortgage companies must halt foreclosure proceedings. While the stay is temporary and may be challenged, it can help you avoid home eviction or the repossession of your cars and appliances.

Atlee Chapter 13 Bankruptcy Attorney

Chapter 13 bankruptcy is a form of legal debt reorganization. Like Chapter 7 bankruptcy, it is a procedure in federal court that begins with the filing of a bankruptcy petition and schedules. Chapter 13 bankruptcy is different from Chapter 7 bankruptcy in that rather than providing for an outright discharge of someone’s liabilities, it allows them to repay some or all of their debt over three to five years.

A Chapter 13 bankruptcy is also used when a debtor does not qualify to file for Chapter 7 relief. The means test required by the new bankruptcy law prevents some people from filing for Chapter 7 bankruptcy. Whether or not a debtor qualifies for Chapter 7 can be determined by one of our Atlee bankruptcy attorneys. Call (804) 664-3643 to schedule your FREE consultation today.

In addition to the means test, the new bankruptcy law requires people filing for Chapter 13 bankruptcy to undergo required credit counseling before they can actually file with the Bankruptcy Court. The new bankruptcy law has also changed the amount of debt appropriate for this chapter. The new law has also changed the length of time required between filing a Chapter 7 bankruptcy and a Chapter 13 bankruptcy to four years.

Atlee Chapter 11 Bankruptcy Attorney

Chapter 11 bankruptcy allows individuals and businesses to consolidate debt into one monthly payment while continuing to meet day-to-day business or personal needs. Fisher-Sandler, LLC – Richmond, VA, has been practicing in bankruptcy law for a combined 60+ years and provides trusted advice when it comes to deciding which debt management solution is best. Atlee Virginia – About

Atlee was known for its two train stops and more than likely its namesake came from a delegate to the state legislature who lived in the area, Jacob S. Atlee. There were two stations, West and East Atlee. In 1921 they were combined. Until 1931, there was a telegraph office also. In 1947 Atlee was a flag stop until 1960. In the late 1950s, the C&O railroad petitioned the State Corporation Commission for authority to stop freight handling at Atlee.

The Atlee area was mostly rural until the 1980s. interstate 295 was constructed through the area in the early 1980s and the widening of U.S. Route 301 from a 2 lane highway to a 4 lane divided highway in the late 1960’s paved the way for master-planned developments such as King’s Charter. The Atlee area went through small growths until the early 2000’s with many new residential developments and most notable mixed-use development, Rutland, which sits on an 18th-century historic farm by the same name. The community is over 200 acres and features national, regional and local shopping with a Kroger Marketplace as the anchor.
