Rockville Chapter 7 Bankruptcy Attorney

Whether it is you, a family member or your small business experiencing financial hardship in this tough economy, sometimes filing for Chapter 7 bankruptcy protection in Rockville Virginia is the best solution for your most difficult problems. Chapter 7 bankruptcy provides debt relief for qualified individuals and businesses. While Chapter 7 does not enable you to restructure secured debt or catch up on past-due payments or taxes, our experienced Rockville bankruptcy attorneys can help clients in Hanover County discharge unsecured debt, providing them with a clean slate.

Chapter 7 is preferable to Chapter 13 for most individuals, assuming they can pass the bankruptcy means test. Filing for Chapter 7 bankruptcy will allow you to discharge your unsecured debt, including:

  • Medical bills
  • Credit card debt
  • Personal loans
  • Payday loans
  • Contractual debt (deficiencies)
  • Legal judgments

The automatic stay is part of the fresh financial start that the law guarantees because it allows you to better organize your finances without undue pressure from moneylenders. The real fresh start comes with the discharge order, which is discussed below.

Rockville Chapter 13 Bankruptcy Attorney

Chapter 13 bankruptcy in Rockville Va allows debtors to reorganize and pay off the unsecured debt over a three-five year period. In many cases, the unsecured debt is discounted, and the debtor only pays a portion of the debt. Your individual circumstances, including income, expenses and total debt, are examined to determine the amount of your payments and whether your unsecured debt will be discounted.

Finding the right Rockville chapter 13 bankruptcy attorney will ensure you’re protected as you file for bankruptcy and reorganize your finances. This process involves attention to detail and a specific process that must be followed properly. For this reason, we encourage you to enlist the help of an experienced Rockville bankruptcy lawyer at Fisher-Sandler with experience in chapter 13 bankruptcy. An experienced bankruptcy lawyer will understand this process and have experience filing the necessary paperwork.

To qualify for Chapter 13 in Rockville, you have to meet several basic requirements. Overall, you have to prove that you can create a realistic payment plan and sustain an income steady and high enough to complete the payments. Understanding the complex paperwork, deadlines, and legalities, though, can get complicated, so we urge you to discuss it with our dedicated bankruptcy team.

While chapter 13 in Rockville does have some strict eligibility requirements, it also comes with several advantages. For example, chapter 13 usually allows you to repay your secured debts, even if you’re behind on the payments, without having the property that secures the debt repossessed or foreclosed on. In other words, you may get to keep your car or house. You may even be able to lump your past due payments in with your payment plan and pay them off over a period of years. The point is, there are options.

Rockville Chapter 11 Bankruptcy Attorney

Chapter 11 bankruptcy Case in Rockville begins with the filing of a petition with the bankruptcy court. As with cases under other chapters of the Bankruptcy Code, once the petition is filed, you will immediately get the benefit of the “automatic stay” which is an order that prohibits your creditors from taking collection actions against you. All debt collection action including lawsuits, garnishments, and foreclosures are suspended, giving you time to negotiate with your creditors on a repayment plan. The automatic stay continues until the court approves your plan of reorganization.

After you file for Chapter 11 bankruptcy, you’ll disclose your income, assets, and debts on official bankruptcy forms. It is at that point that you begin negotiating your reorganization plan with your creditors. Why would your creditors be willing to negotiate with you? It is because the creditors know that if they don’t you might be forced to file a Chapter 7 and they would receive little or nothing.

Chapter 11 is a very complex area of law. If you are a high-income debtor with significant assets or if you have exceeded the debt limits of Chapter 13 bankruptcy, you may want to consider filing Chapter 11 bankruptcy. Take the time to talk to an experienced Rockville bankruptcy attorney at Fisher-Sandler, about how Chapter 11 bankruptcy can work for you. Contact us at (804) 664-3643 to schedule your FREE consultation.

Rockville Emergency Bankruptcy Attorney

An emergency bankruptcy in Rockville Virginia is a means to file for bankruptcy which can be done more quickly and with fewer requirements than an ordinary bankruptcy. Generally, the reason a debtor may want to file on an expedited basis is to protect an asset from creditor action. This is because when a bankruptcy is filed the “automatic stay” will go into effect. The stay will immediately stop most creditors from attempting to collect on the debts owed to them. If a debtor needs to quickly halt foreclosure on their home, possibly stop an eviction, or protect their pay from garnishment, an emergency bankruptcy could be a way to achieve this goal.

Filing An Emergency Bankruptcy in Rockville

In general, to file an emergency bankruptcy, you will need to provide the court with basic information such as your contact information and social security number, a list of all your creditors and their addresses, and proof that you have completed a mandatory credit counseling course from an approved provider. If you were not able to take this course before filing you will have to provide the court with evidence that there were emergent circumstances that prevented you from doing so or be granted an exemption from the requirement. After you have provided the requisite documents and information, you will be required to provide your missing data within a specific number of days.

Rockville Virginia – About

Rockville is an unincorporated community in Hanover County in the Central Region of the U.S. state of Virginia. Rockville was named after early 19th-century postmaster, William Rock. Prior to the name “Rockville,” the community was named “Dentonsville,” after postmaster Allen Denton, the descendant of colonial settler Thomas Denton, whose tavern (“Denton’s Tavern”) exists today as a private residence. When Allen Denton sold the tavern to William Rock, the name of the community also changed to reflect the new postmaster. The community formerly consisted primarily of farmland. Today many Rockville residents commute to jobs in Richmond. Additional information on the early history of Rockville is available from Gary L. Denton, Attorney at Law, 14453 Riverside Drive, Ashland, VA 23005.

While most of the land in the area is still farmland, some of the land has been developed into subdivisions. One example of this is Carrington Glen, a rural conservation development (meaning 70% of the land remains undeveloped and undisturbed by development) of new homes on an old farm tract. Other large neighborhoods in the area include Shop Creek and Willoughby.
